The Court of Appeal struck out the corruption charges filed by the Economic and Financial Crimes Commission against a serving judge of the Federal High Court, Justice Hyeladzira Nganjiwa. The appellate court agreed with the submission of the appellant that a judge could not be prosecuted until such judge had either been dismissed or compulsorily retired by the National Judicial Council. The Supreme Court also dismissed the appeal filed by the prosecution and upheld the decision of the Court of Appeal which quashed the corruption charge against the defendant.
