During the course of the trial, the prosecution counsel opposed the claims of the defense with several evidence that the 2nd Defendant had used part of the money N4.9 million to pay the media as contained in the false retirement and had diverted the sum of N400,000 for his personal use. Delivering his judgment, the judge said that the prosecution had proved beyond reasonable doubt that the 2nd Defendant failed to use the money for the purpose it was meant for. He therefore sentenced him to seven (7) years imprisonment for making false returns, and another five (5) years for abuse of office and conferring corrupt advantage on himself. The sentencing would run concurrently.
